I. TERMINOLOGY
1.1. For a more precise understanding of the terms of this Cookie Policy, terms are used herein with the following meanings:
1.1.1. Policy refers to this document (Cookie Policy) posted at the following link: https://darkbyrior.ua/en/cookie-policy
1.1.2. Website means the web page posted at darkbyrior.ua, including all subdomains (subfolders), owned by the Website Administration.
1.1.3. Website Administration refers to the Individual Entrepreneur Pospiekhova Mariia Vadymivna (RNOKPP: 3607610829; address: 49111, Dnipropetrovsk oblast, city of Dnipro, Zaporizke shose, building 28Ts, apartment 61, entry number in the Unified State Register 2002240000000150145 dated February 1, 2021), registered in accordance with the current legislation of Ukraine and/or persons authorized by her to manage the Website. Throughout the text of the Policy, references to the Website Administration mean simultaneous references to the authorized persons of the Website Administration as well.
1.1.4. User means an individual who has full civil capacity and legal capability and who uses the Website.
1.1.5. GDPR means Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (link: https://eur-lex.europa.eu/eli/reg/2016/679/oj).
1.1.6. Personal Data means any information relating to an identified or identifiable natural person (User); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person (paragraph 1 of Article 4 of the GDPR).
1.2. Solely the Website Administration, apart from a court, has the right to interpret the Policy and the terms used therein.
II. GENERAL PROVISIONS
2.1. The Website Administration uses cookies. Cookies are small text files installed on the User's device. Cookies collect information that facilitates the use of the Website, for example, by remembering information about the User regarding system login or language settings. The Website uses first-party cookies of the Website Administration, which are set directly by the Website, and third-party cookies, which are administered from a domain different from the Website's domain and placed on the Website by another organization.
2.2. Cookies are used by the Website Administration to ensure the proper functioning of the Website, including, but not limited to, ensuring security and preventing abuse (including preventing access by unauthorized persons); adapting the Website content to the User's preferences and end device; optimizing the use of the Website; preventing internet bots from performing certain actions on the Website; simplifying login to the User's account and enabling navigation between subpages on the Website without the need to log in again on each subpage; creating anonymous aggregated statistics that help understand how the User uses the Website, which allows improving its structure and content; contributing to the improvement of the Website's performance, including checking its efficiency; determining what advertising to show the User, as well as displaying advertisements on external websites, applications, including those that best match the User's activity on the Website.
2.3. The Website Administration may process data regarding the User's use of the Website via a computer, phone, tablet, or other device through which the User accesses the Website. Some of this data in combination with other data may constitute Personal Data, which is protected in accordance with the Website's privacy policy. By using internet technologies, the Website Administration may process:
2.3.1. The name of the website from which the cookies originate, the duration of their storage on the end device, and their unique number;
2.3.2. Device data (e.g., device type/model, unique device identifiers, MAC address, IP address, operating system, operating system version and device settings, installed language, screen resolution, version and type of web browser);
2.3.3. Events (e.g., time of website use, last website visit, duration of website visit, type of visited pages and subpages, at which step the User is when making purchases);
2.3.4. Location data (e.g., IP address, User location data obtained using various positioning technologies);
2.3.5. Other data: data on the use of the Website (e.g., access source; advertising campaign from which the User entered the Website; links clicked by the User; what advertisements the User saw and what consents the User provided on the cookie banner).
2.4. The Website Administration regularly uses website scanning tools to determine which cookies are stored on the User's device so that the list of used cookies is as accurate as possible.
2.5. The Website Administration uses the following categories of cookies:
2.5.1. Essential;
2.5.2. Functional;
2.5.3. Analytical;
2.5.4. Marketing (advertising);
2.5.5. Social media cookies.
2.6. The User grants consent to the use of cookies specified in clause 2.5. of this Policy regarding them. If the use of cookies is carried out with the collection and/or processing of Personal Data, the User grants consent to the collection and processing of Personal Data for the purpose of using cookies.
III. ESSENTIAL COOKIES
3.1. The Website Administration's use of essential cookies is necessary for the Website to function at a proper level with optimized features for the User. These files are set, in particular, for the purpose of remembering login sessions or filling out forms, as well as for purposes related to configuring privacy settings.
3.2. Essential cookies are processed in connection with the performance of the User Agreement (point (b) of paragraph 1 of Article 6 of the GDPR), and the legal basis for processing essential cookies is also the legitimate interest of the Website Administration, which consists in ensuring the operation of the Website (point (f) of paragraph 1 of Article 6 of the GDPR).

IV. FUNCTIONAL AND ANALYTICAL COOKIES

4.2. Analytical cookies allow obtaining information such as the number of visits and traffic sources on the Website. They are used to determine which pages are more popular and which are less popular, and to understand how Users navigate the Website by maintaining Website traffic statistics. Data processing is carried out to improve the efficiency of the Website. The information collected by these cookies is aggregated and is not intended to identify the User.
4.3. The legal basis for processing functional and analytical cookies by the Website Administration is its legitimate interest (point (f) of paragraph 1 of Article 6 of the GDPR), which consists in ensuring the highest quality of services/goods provided on the Website.

V. MARKETING (ADVERTISING) COOKIES
5.1. Marketing (advertising) cookies allow adapting the displayed advertising content to the User's interests on the Website and beyond. Based on information from these cookies and the User's activity on other websites, a profile of the User's interests is created.
5.2. The legal basis for processing personal data in connection with the use of marketing (advertising) cookies by the Website Administration is its legitimate interest (point (f) of paragraph 1 of Article 6 of the GDPR), which consists in promoting the brand of the Website Administration and informing about the current offer of the Website Administration.

VI. MANAGING COOKIE SETTINGS
6.1. The use of cookies for collection requires the User's consent. On the Website, the Website Administration obtains consent from the User through a corresponding PopUp window. Data regarding the User's consent to the use of cookies is stored by the Website Administration. If, due to a technical glitch, the Website Administration fails to obtain the User's consent through the corresponding PopUp window, it is presumed that the Website Administration has obtained the relevant consent from the User until its withdrawal.
6.2. The Website Administration is not obliged to obtain the User's consent in the event that the use of cookies is necessary for the provision of telecommunication services (data transmission for content display). In this case, if the User disagrees that such consent has been provided by them, they must immediately cease using the Website and send a notification to the Website Administration at the email address sales@darkbyrior.ua regarding the withdrawal of consent to the use of cookies.
